At the end of the contract term, customer access to the ElevenLabs Services is terminated in line with the agreement. Customers may extract their data at any time prior to contract expiration or termination via the web-based user interface or APIs.
Following contract expiration or termination, Customer Content is retained for up to thirty (30) days and is then securely deleted from the Services, unless the customer has explicitly consented to retention beyond this period. Data deletion is performed as part of ElevenLabs’ standard service lifecycle and security processes.
The above is included in the price of the contract. Any retention of Customer Content beyond the standard 30-day post-termination period is not included in the contract price and requires explicit customer consent and a separate agreement. We provide for certain uptime commitments for our core services under a formal Service Level Agreement (SLA). For our Text-to-Speech API, we commit to 99.9% monthly uptime, measured on a per-minute basis. For our conversational Agents product, we commit to 99.5% monthly uptime, calculated as the average success rate of requests across each minute in the month. Availability is measured 24/7, excluding scheduled maintenance, force majeure events, customer-side issues, and other standard SLA exclusions.
If we fail to meet the applicable uptime commitment in a given month, customers are eligible for service credits as their sole and exclusive remedy. For both the TTS API and Agents, uptime below the commitment but above 98.0% results in a 5% service credit, and uptime below 98.0% results in a 10% service credit, calculated as a percentage of the monthly fees for the affected service. Service credits must be requested within 14 days after the relevant month and are applied as credits against future invoices, subject to standard eligibility conditions. - Approach to resilience

- Measures to identify, mitigate and manage modern slavery risks relating to the contract and how these will be implemented
- Outline policies and practices to be applied to or put in place for the contract to mitigate and manage modern slavery risks, including: Pre-employment checks, recruitment practices. Workplace conditions, safeguarding plans and processes in place and regular monitoring with relevant groups considered, which may include sampling

- How to ensure business decisions re: price/cost, short lead times, payment timescales do not create modern slavery risks in the supply chain
