Customer data remains hosted within the customer’s Amazon Elastic VMware Service (Amazon EVS) environment inside the customer’s AWS VPC. Amazon EVS deploys and runs a VMware Cloud Foundation environment on EC2 bare metal instances in the customer’s VPC, and customer workloads run as standard VMware virtual machines within that environment.

When the contract ends, users extract or migrate their data by exporting or moving VMware virtual machines using VMware-supported formats and tools (for example, vMotion/OVF where applicable) and migration tooling such as VMware HCX, which Amazon EVS supports for workload migration. Data extraction and migration are performed by the customer within their AWS account. No supplier-managed data extraction is required. - End-of-contract process

At the end of the contract, the customer’s right to use VMware Cloud Foundation software licences ends in line with the applicable VMware (Broadcom) licence terms. This service provides software licences only and does not include a supplier-provided availability guarantee or SLA.
Availability commitments are defined by Amazon Web Services Elastic VMware Service (EVS) under the AWS EVS Service Level Agreement. AWS EVS provides an availability commitment for the EVS service based on the monthly uptime percentage of the EVS environment, subject to the customer meeting AWS configuration and usage requirements.
If AWS does not meet the EVS SLA, eligible customers may receive service credits in accordance with the AWS EVS SLA terms. Any refunds or credits are provided by AWS, not the supplier.
VMware Cloud Foundation includes software capabilities that support high availability when deployed on resilient infrastructure, but no availability SLA or service credits are provided as part of this licence-only service. - Approach to resilience
